FOOD TRUCK NATION — PILOT TERMS OF USE & PRIVACY NOTICE

Market Pilot — Effective October 26, 2026

Food Truck Nation, LLC (“FTN,” “we”) is running a pilot connecting Florida property hosts with licensed food truck operators. These terms cover the pilot pages on foodtrucknation.com, the public listing catalog, the host and operator application forms, the booking and checkout pages, and communications with us during the pilot. They apply alongside the Host Pilot Agreement or Operator Pilot Agreement you accepted. If these terms conflict with that agreement, the agreement controls, except that Sections 8 through 10 of these terms govern how we collect, store, and retain your information. These terms do not govern FTN’s software platform, which is not open to users.

1. Eligibility and operator codes

You must be at least 18 and using the pilot for business purposes. If you accept on behalf of a company, you represent that you can bind it. Provide accurate information and keep it current. Browsing the catalog is open to anyone; booking requires an operator code we send you after verification, one for each truck. Keep it confidential; you are responsible for every booking made with your code.

2. Listings are supplied by hosts

A “Site Day” is the right to operate a mobile food business and make retail food sales to the public from a designated vending area of a host’s property during the listed hours; what an operator pays for a Site Day is paid for that vending opportunity. The vending area is for food service only: an operator may not leave any vehicle there outside the booked hours, or any vehicle other than its food truck or trailer (and a trailer’s tow vehicle, which counts toward the area the setup needs) at any time. Each listing describes a site the host controls. We may edit a listing’s text to keep street addresses, phone numbers, email addresses, and gate or door codes out of the public catalog. We do not inspect sites, verify descriptions, or guarantee that a site will match its listing. We publish no foot-traffic or revenue estimates during the pilot, and nothing on the catalog is a representation about demand, customers, or sales at any location. A listing is an offer by that host to that host’s counterparty — it is not an offer by FTN.

3. Our role

FTN facilitates introductions, verification, scheduling, and payment collection. FTN is not a party to any booking between a host and an operator, and is not a real estate broker, landlord, property manager, insurer, guarantor, food service provider, or employer of either party. We review compliance documents to confirm they are legible, unexpired, and appear on their face to be the type of document requested, and make the checks described in Section 4; that review is not certification, endorsement, or ongoing monitoring, and legal and regulatory responsibility stays with each party. When something goes wrong between a host and an operator we will record it and pass it along. We will not assign fault, arbitrate, or pay claims. Nothing in the pilot creates a partnership, joint venture, agency, franchise, or employment relationship among FTN, any host, and any operator.

4. What verification covers

Verification on FTN is specific, and its limits matter. For operators, it means we have collected each of the seven required documents, checked them for facial validity, confirmed the insurance certificate with the carrier, broker, or agent, and suspended booking access if anything lapses. For hosts, it means we have confirmed the business exists and is active with the Florida Division of Corporations, matched the site against county property appraiser records, and confirmed the general liability certificate with the carrier, broker, or agent. FTN does not guarantee the accuracy, coverage scope, or continued validity of any insurance policy and is not liable for errors or omissions in carrier, broker, or agent confirmations. Verifying a host does not mean we have confirmed that the host may lawfully license the site, that a lease or association permits food truck operations there, that the site is zoned for them, or that the site is as described — those rest on the host’s own representations, and we do not inspect sites. Apart from tracking the expiration dates on file, verification is a point-in-time check, not certification and not ongoing monitoring.

5. Third-party services

The pilot runs on tools we did not build: Make (automating listings, bookings, checkouts, emails, refunds, and payouts), Stripe (all payment processing, host payouts, and host identity verification), Tally (application forms, document upload, and the post-day survey), Hostinger (website hosting and email), Google (spreadsheets, file storage, and website analytics), and Anthropic (Claude, an AI assistant FTN uses to run the pilot, which can read the pilot’s form submissions and the files and spreadsheets in FTN’s Google account). Each provider’s own terms and privacy policy apply to the part it handles. We are not responsible for their outages, errors, or acts, and their availability is outside our control.

6. Fees, payment, and tax

FTN’s fee on each Site Day is the greater of $30 or 30% of the site’s price — 20% charged to the host and 10% to the operator, both calculated on that same site price, with the operator covering any shortfall to the $30 floor. Operators also pay a service fee of 4% of the site’s price and the booking fee, shown as its own line at checkout. FTN does not currently collect sales tax on Site Days. If FTN or a taxing authority determines that tax applies to a Site Day, FTN may add it to the operator’s charge as a separate line and may adjust the rate, the taxable base, or the collection method accordingly; the amount shown at checkout controls. If a taxing authority later assesses sales tax, surtax, or related interest on a Site Day for which tax was not collected, the operator who booked that Site Day will reimburse FTN for the tax and interest within thirty (30) days of FTN’s written request, and FTN may offset that amount against any refund owed to the operator. Payment completes a booking; an unpaid checkout books nothing. Stripe processes every payment — we never receive or store your card or bank credentials. On priced bookings the host’s share is allocated to the host’s own Stripe balance at the moment of payment; FTN controls only when that payout is released, never where it goes, except to fund a refund these terms or the pilot agreements provide for, and this is not an escrow arrangement.

7. Acceptable use

Do not: provide false, altered, or fraudulent documents or information; impersonate anyone; list a property you have no right to license; book on someone else’s behalf without telling us; harass or discriminate against another participant; scrape or bulk-extract the catalog; or interfere with the tools above. We may suspend or remove anyone for any of these, immediately; any refund of fees already paid follows your pilot agreement. Suspension or removal does not limit any other right or remedy available to FTN, including under the indemnification and dispute provisions of these terms.

8. What we collect

From everyone: name, title, business name, email, phone, and the content of your messages with us. From operators: the seven compliance documents — business license, health permit, mobile food vendor license, general liability certificate, commercial auto certificate, vehicle registration, fire safety inspection — plus cuisine, equipment type, insurance carrier, each document’s expiration date, your setup’s length and width, whether your business is established or newer, where you vend now, how you heard about FTN, photos of your truck or trailer if you send them, and the operator code we assign. From hosts: site address, a business mailing address if it differs, venue name and type, county, a description of the site, the vending area’s size, photos, pricing and availability, what’s included, access instructions (including any gate or door codes), whether you serve alcohol, a general liability certificate and its expiration date, whether you own or lease the site, and — if you lease — whether your lease permits food truck operations on it. We do not collect deeds, leases, or landlord letters; your attestation and the public-record checks in Section 4 are what we rely on. From bookings: dates, amounts, payment status, cancellations, photos you send us of a problem with a site, post-day survey answers, and each booking request and checkout an operator starts, paid or not. Stripe separately collects the identity and banking information it needs from priced hosts under its own terms. Our website host keeps standard server logs (IP address, browser, and pages requested).

Our website uses Google Analytics to count visits and see which pages are used. It sets cookies in your browser and doesn’t use them for advertising.

9. Where it is stored, and who sees it

Applications and post-day surveys are submitted through Tally, which stores submissions on servers in the European Union. We copy application documents and responses into a Google account Food Truck Nation controls in the United States; by applying you consent to that transfer. Access is limited to the two Food Truck Nation personnel running the pilot and to the service providers named in Section 5; the folders holding your documents are not publicly shared and are not linked from any page. When a Site Day is booked, we give the operator the host’s name, phone, and email, the site’s exact address, and its arrival instructions (any gate or door codes go by email on the morning of the Site Day), and give the host the truck’s name, cuisine, and photo, and its phone for problems with the site on the day; cancellations, changes, and future bookings go through FTN. Stripe holds payment and banking details under its own terms. We do not sell, rent, or trade your information, and we do not use it for advertising. We contact your insurance carrier, broker, or agent solely to confirm a certificate is genuine, and we check Florida Division of Corporations and county property appraiser records, which are public. We will not contact your landlord or a property owner of record, except where required by law or reasonably necessary to protect FTN’s rights or the safety of pilot participants. No system is perfectly secure: we use commercially reasonable administrative, technical, and physical safeguards appropriate for the nature and volume of information we hold, and if we learn of a breach affecting your information we will tell you, as Florida law requires.

10. How long we keep it

Compliance documents and property records — insurance certificates, licenses, permits, site photos, truck photos, and property appraiser records — are deleted within 90 days after the pilot ends, except any we must keep for tax, insurance, or legal reasons. Gate and door codes are deleted within 90 days after the pilot ends as well. Booking, payment, and outcome records — dates, amounts, cancellations, and survey answers — stay in our business records, and we may use them, including in de-identified or aggregated form, to evaluate and report on the pilot. Ask us at legal@foodtrucknation.com to delete your documents early and we will, unless we are required to keep them — in which case we will tell you what we kept and why.

11. Communications and consent

You agree to receive emails from us about your application, verification, Stripe setup, your listing, bookings, cancellations, reminders (including before a document or certificate expires), payouts, and the post-day survey, at the address you give us. Cancellations and changes go through FTN by email; Section 9 says which contact details each side of a booking receives. We do not record calls unless we ask first and you agree — Florida requires the consent of everyone on the line.

12. Events outside anyone’s control

If a hurricane or tropical storm, evacuation or government order, fire, utility failure, public health emergency, or another event outside either party’s reasonable control makes a Site Day impossible or unsafe, either party may cancel it without fault and without penalty, and the operator is refunded in full — FTN’s fee and the service fee included. FTN will issue the refund to the original payment method. To fund the refund, FTN may withhold, reverse, or offset the host’s share of that booking, including from the host’s pending or future payouts, and the host will repay any portion already paid out. Tell us as soon as you know. Neither party owes the other anything further for that Site Day, and nothing here excuses an obligation that arose before the event.

13. Photos, listings, and feedback

When you give us site photos, truck photos, listing text, logos, or menu images, you confirm you have the right to them and you give FTN permission to display and share them to promote the pilot and its listings — on the catalog, on our website, and on social media. That permission ends when the pilot ends, except for material already published, and you may ask us to take a specific item down. Ideas, suggestions, and answers you give us in surveys or interviews may be used by FTN without restriction or payment. We don’t publish or share an individual operator’s reported sales or customer counts outside FTN; anything we publish or share from them is aggregated or de-identified.

14. Disclaimer of warranties

THE PILOT, THE CATALOG, THE BOOKING TOOLS, AND EVERYTHING WE PROVIDE ARE FURNISHED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE MAKE NO WARRANTY ABOUT ANY SITE, ANY HOST, ANY OPERATOR, OR ANY COMMERCIAL RESULT.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FTN IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUE, DATA, OR GOODWILL. FTN’S TOTAL AGGREGATE LIABILITY ARISING OUT OF THE PILOT WILL NOT EXCEED THE GREATER OF FIVE HUNDRED DOLLARS ($500) OR THE FEES YOU PAID TO FTN IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits apply even if a remedy fails of its essential purpose, but do not apply to liability arising from FTN’s gross negligence or willful misconduct.

16. Indemnification

You will indemnify, defend, and hold harmless FTN and its officers, members, employees, and agents from claims, damages, losses, liabilities, costs, and reasonable attorneys’ fees arising from your breach of these terms or your pilot agreement, your use of the pilot, any booking, injury or property damage at a site, your violation of law, or any misrepresentation in what you gave us. This survives the pilot.

17. Disputes

Florida law governs, without regard to conflict-of-laws rules. Before starting any proceeding, give us written notice at legal@foodtrucknation.com and allow 30 days to resolve it informally. Any dispute that remains will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in St. Lucie County, Florida, with any hearing held by video unless the arbitrator decides an in-person hearing is necessary. You and FTN each waive any right to a jury trial and to participate in a class, collective, or representative action. Either party may seek injunctive relief in the state or federal courts serving that county, and either party may bring an individual action in small claims court if the claim qualifies. To the extent permitted by applicable law, any claim not arising out of a contract must be brought within one year after it accrues.

18. Changes and end of the pilot

The pilot has no fixed length; FTN may extend or shorten it and will notify you by email of the date it ends. We may modify these terms by posting a revised version on the pilot website at least seven (7) days before the change takes effect and, for anyone who has already accepted these terms, by also emailing notice to the address on file at least seven (7) days before the change takes effect; continued participation after the effective date means you accept the revised terms. Changes do not apply retroactively to bookings already confirmed and paid before the effective date. We may also change, suspend, or end the pilot at any time; confirmed and paid bookings will be honored or refunded. If any provision is unenforceable it is narrowed to the minimum extent necessary and the rest stands. You may not assign these terms; we may.

19. Accepting these terms and contacting us

Ticking the acceptance box on our application form, or booking a Site Day, is your electronic signature and binds you to these terms.
